1. Acceptance of Terms

By accessing or using the MediQuick mobile application, website, or any other services provided by MediQuick (collectively, the "Services"), you agree to be bound by these Terms of Services. If you do not agree to these terms, please do not use our Services.

These Terms of Services constitute a legally binding agreement between you and MediQuick Labs Pvt. Ltd. ("MediQuick," "we," "us," or "our"). You must be at least 18 years old to use our Services. If you are using the Services on behalf of a minor, you represent that you are the legal guardian of such minor and assume full responsibility for ensuring compliance with these Terms of Services.

2. Description of Services

MediQuick provides a platform that connects users with healthcare providers, facilitates appointment scheduling, enables virtual consultations, and offers other healthcare-related services. Our Services may include, but are not limited to:

Appointment booking with healthcare providers
Virtual consultations with healthcare providers
Access to and storage of medical records
Health information and educational content
Medication reminders and health tracking
Payment processing for healthcare services

MediQuick is not a healthcare provider. We facilitate connections between users and independent healthcare providers. The healthcare providers available through our platform are not our employees or agents. We do not practice medicine or provide medical advice.

3. User Accounts

To access certain features of our Services, you must create an account. When you create an account, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Keep your password secure and confidential
Notify us immediately of any unauthorized use of your account
Be responsible for all activities that occur under your account

We reserve the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, false, or misleading, or if you fail to comply with these Terms of Services.

4. User Responsibilities

When using our Services, you agree to:

Use the Services in compliance with all applicable laws and regulations
Provide accurate and complete information about your health and medical history
Attend scheduled appointments or cancel/reschedule in accordance with our cancellation policy
Pay all fees associated with the Services you use
Use the Services only for their intended purposes

You agree NOT to:

Use the Services for any illegal or unauthorized purpose
Impersonate any person or entity
Interfere with or disrupt the Services or servers or networks connected to the Services
Attempt to gain unauthorized access to any portion of the Services
Use the Services to transmit any viruses, worms, or other malicious code
Collect or harvest any information about other users
Use the Services in any way that could damage, disable, overburden, or impair the Services

5. Healthcare Services

MediQuick facilitates connections between users and healthcare providers but does not provide medical services directly. You acknowledge and agree that:

Healthcare providers available through our platform are independent professionals responsible for their own services
MediQuick is not responsible for the quality, timing, or appropriateness of the healthcare services provided
Any information or advice provided by healthcare providers through our platform does not create a doctor-patient relationship with MediQuick
Virtual consultations may have limitations compared to in-person consultations
In case of emergency, you should call emergency services (e.g., 911) or go to the nearest emergency room

You are responsible for evaluating the qualifications and appropriateness of any healthcare provider you choose to consult with through our platform.

6. Payments and Fees

By using our Services, you agree to pay all fees applicable to the services you use. Payment terms include:

Fees for healthcare services are set by the healthcare providers and may vary
MediQuick may charge platform fees for using our Services
All fees are displayed before you confirm your appointment or service
Payment must be made at the time of booking or as otherwise specified
We accept various payment methods as indicated in the app

Cancellation and refund policies:

Appointments cancelled more than 24 hours in advance may be eligible for a full refund
Late cancellations (less than 24 hours before the appointment) may be subject to a cancellation fee
No-shows may be charged the full consultation fee
Refunds are processed to the original payment method within 5-7 business days

7. Intellectual Property

The Services and all content, features, and functionality thereof, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the design, selection, and arrangement thereof, are owned by MediQuick, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Subject to these Terms of Services, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your personal, non-commercial use. You may not:

Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services
Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text
Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the Services
Access or use for any commercial purposes any part of the Services or any services or materials available through the Services

8. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MEDIQUICK DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Services will meet your specific requirements
The Services will be uninterrupted, timely, secure, or error-free
The results that may be obtained from the use of the Services will be accurate or reliable
The quality of any products, services, information, or other material purchased or obtained by you through the Services will meet your expectations
Any errors in the Services will be corrected

MEDIQUICK DOES NOT PROVIDE MEDICAL ADVICE. THE CONTENT PROVIDED THROUGH THE SERVICES IS FOR INFORMATIONAL PURPOSES ONLY AND IS NOT INTENDED AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MEDIQUICK, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

10. Indemnification

You agree to defend, indemnify, and hold harmless MediQuick, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Services or your use of the Services, including, but not limited to, your User Contributions, any use of the Services' content, services, and products other than as expressly authorized in these Terms of Services, or your use of any information obtained from the Services.

11. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Services.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion.

All provisions of these Terms of Services which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

These Terms of Services and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of India, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms of Services or the Services shall be instituted exclusively in the courts of Bangalore, Karnataka, India, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Services in your country of residence or any other relevant country.

13. Changes to Terms

We may revise and update these Terms of Services from time to time at our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Services thereafter. Your continued use of the Services following the posting of revised Terms of Services means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.
